Supreme Court Case Filed Regarding Judicial Review of Allegedly Fraudulently Procured Arbitration Awards, S...
By God's grace alone, I filed the cert petition with the Supreme Court on January 23, 2012. I will have a lot more information in the coming days. Analysis. Details. Humorous anecdotes about a pro se litigant writing and submitting a cert petition. That kind of stuff.
But today, I am just praising the Lord and giving thanks to God that He has guided my steps and directed my paths through all of this. Those of you who have been following this blog for the last few years know that my faith has guided and sustained me through some of the darkest days a person could endure.
Unemployment. Foreclosure. A custody fight.
Broke - but NOT Broken.
"Do not lie in wait, O wicked man, against the dwelling of the righteous;
Do not destroy his resting place;
For a righteous man falls seven times, and rises again,
But the wicked stumble in time of calamity."
Proverbs 24:15-16
This has been going on for more than four years. This is not the path I chose. But this is the path that has been chosen for me based on the actions of the Respondents. And this is the path that God has allowed. So, I continue down this path and trust God's will and purpose completely. God's will is perfect. Always.
Plenty of news to share with you on all of this - the Supreme Court case, FINRA, the case filed in state court against Dwight Wanken, etc. I'll get to all of it in the next few days.
Today is a day to Praise the Lord for His faithfulness, His goodness, His love.
There is no way that I could have written this brief without God's direction and guidance. I've said it before, I'll likely say it again. I'm just a guy with a slingshot and a smooth stone.
This most definitely is a David vs. Goliath story.
The questions before the Supreme Court in this petition are weighty. The essence of them is whether a court can prematurely dismiss allegations that an arbitration award was fraudulently procured, which is how I have alleged the Respondents in this case procured a favorable award.
At issue is whether the Supreme Court will resolve a split among the circuit courts regarding judicial review of arbitration awards involving allegations of fraudulent procurement.
I have also averred that the summary judgment granted was inappropriate, violating statute and precedent, given unresolved issues of genuine material fact and unreviewed evidence. I have further argued that the district court and Fifth Circuit failed to follow precedent with regard to how it treated my pleadings as a pro se litigant. Finally, I have asked the Court to exercise its supervisorial powers over the lower courts given their departure from usual judicial proceedings.

No matter *what* happens with this petition, I know the promise I have in Jesus Christ. I know that the time here on earth is a blink compared to eternity. I know that the evil, wicked and unjust will be punished by God in a way that no earthly court could. And I know that God created justice and is the real Chief Justice. And I think that Chief Justice Roberts would agree with that statement.
No matter what happens with the case, I am at peace. I know Who my hope is and I know What my hope is.
I hope you know the hope and promise we have in Christ. That He gives us the ability to endure anything. To trust His will completely. To know that He is in control and we can rest peacefully.

So, you watched the Heisman ceremony, right?
Baylor's first game against TCU was wild to the very end. And they kept it going all season long against top ranked teams. You knew there was something special about Baylor this year. And there was. Robert Griffin III. A young man who loves the Lord, who gives Him the glory for his victories. RG3 is impressive. By God's grace, he made history winning Baylor's first Heisman trophy.
He kind of reminds you of another young quarterback, doesn't he?
Of course I'm talking about Tebow. Looks like the mockers have been silenced, doesn't it?
Tim Tebow is a gifted athlete - and he knows Who gave him those gifts and isn't ashamed to give God the glory and praise. It's refreshing in this age of narcissism, self-promotion, conceit, law-breaking and arrogant celebrity tweets.
Makes you think of Paul's letters to Timothy, the young pastor of the church in Ephesus, written to encourage Timothy to persevere and stay firm in his faith.
"Let no one look down on your youthfulness, but rather in speech, conduct, love, faith and purity, show yourself an example of those who believe." 1 Timothy 4:12
Tim Tebow is living that out. It's telling that instead of seeing this upstanding, honorable young man as a role model for our youth, Americans have mocked and attacked Tebow on everything from his faith to his option offense.
I'm having a blast writing my brief to the Supreme Court. Really.
Don't worry. You'll get to see it as soon as it's formatted and on its way. Which should be just about a month before the flag drops at Daytona.
Now if you had told me four years ago that I would be filing a case with the Supreme Court on all of this, I would have had a great laugh with you.
As I have said over and over, this isn't the way I would have written any of this. But it's the way God has decided it will play out. And I trust God completely. And I know that He has a purpose and a plan that is perfect. That His ways are not my ways - and that I can't even begin to understand His ways. But I can trust Him and wait on Him.
I am not a lawyer. I have never argued a case before a judge. I certainly have never argued before the Supreme Court.
And yet, I have perfect trust in God and His plan through all of this. I am weak. But through Him, by Him and in Him, I am strong.
"And He has said to me, 'My grace is sufficient for you, for power is perfected in weakness.' Most gladly, therefore, I will rather boast about my weaknesses, so that the power of Christ may dwell in me. Therefore I am well content with weaknesses, with insults, with distresses, with persecutions, with difficulties, for Christ’s sake; for when I am weak, then I am strong." 2 Corinthians 12:9-10
"I can do all things through Him who strengthens me." Philippians 4:13
When you look around our world, you realize how far from Eden we are. My case is a tragic example of the consequences of sin. Read through any of the briefs that have been filed and you will read allegations of greed, theft, lies and much, much worse. The worst of humanity is outlined in my briefs. It's devastating stuff definitely. Some might lose hope. But not me.
You know why? I know what happens next in His story! It ends (and then continues for eternity) with victory. Evil is defeated. Good wins. If you only knew of the Friday on which Jesus Christ was crucified, you would only know half the story. You wouldn't know that now death has no sting. You wouldn't know that Jesus conquered the grave. You might think that the bad guys will win. That evil will cheat and triumph over good.
But you'd be wrong.
Because we have Sunday.
And we only have Sunday because we had Friday.
And we only have Friday - the day that Christ gave His life for you and for me and for all of us - because God sent His one and only Son to earth, to die for the sins of man. To serve as the only worthy sacrifice. To reconcile us to Him. To bridge the gap of sins that is so wide that the only thing big enough is the wooden cross used to crucify Christ.
Maybe you know the peace that passes understanding. Maybe you understand how I can praise God in this storm. Maybe you know Christ as your Savior, personally and eternally.
I hope so.
But if you don't, I pray you might come close to God this Christmas season. Turn off the news with all the talk about Black Friday, Black Monday, sales data and year over year comparisons. Ignore those Best Buy commercials with the mean mom trumping Santa Claus (who came up with that ad campaign anyway?). Don't listen to all those advertisements that tell you the measure of your relationship or worth comes from the price of the gift you receive on Christmas.
Instead of adding more gifts to buy and things to do to your list, I pray you would add more peace to your life. In two weeks, Christmas morning's treasures will become a memory. The wrapping paper will be in the recycling bin, the leftovers in your fridge and it's highly likely that at least one of your gifts will be on its way to the return department.
But what if this Christmas, you unwrapped the gift of hope and peace? What if this Christmas, the carols we sing became personal? What if Emmanuel became something you believed personally - God with us - instead of just a line in the song? What if Merry Christmas was more than a greeting but a way of life?
I pray that you might know how loved you are. That God sent His own Son for you. That though we are nowhere near Eden, we have the hope of eternity in heaven free from the grip of sin and evil. That there will be a day when the evil, wicked and unrepentant sinners will be judged and sentenced for eternity.
I rest in that knowledge. I guess that's why I am not overwhelmed by the prospect of writing a cert petition to the Supreme Court. And why I would not be intimidated about arguing before the nine justices of the Court. If God is for me, what can man do to me? Nothing. God is the Chief Justice of all. God loves justice - because He created justice. Which means that I can rest in His plan for justice in this case.
"And we know that God causes all things to work together for good to those who love God, to those who are called according to His purpose. For those whom He foreknew, He also predestined to become conformed to the image of His Son, so that He would be the firstborn among many brethren; and these whom He predestined, He also called; and these whom He called, He also justified; and these whom He justified, He also glorified. What then shall we say to these things? If God is for us, who is against us? He who did not spare His own Son, but delivered Him over for us all, how will He not also with Him freely give us all things? Who will bring a charge against God’s elect? God is the one who justifies; who is the one who condemns? Christ Jesus is He who died, yes, rather who was raised, who is at the right hand of God, who also intercedes for us. The birth of a little baby to a poor carpenter and his virgin bride outside of an inn, laid in an animal's manger, surrounded by livestock and visited first by lowly shepherds after an angelic visit.
The birth of the Messiah - known by God from the beginning of time - foretold by prophets of God hundreds of years prior.
He is our hope. Our peace. Our sacrifice.
Yeshua. The Messiah.
Things are going to be busy around here. I'll keep you posted on the cert petition and the case in Dallas County.

Thank You
I give thanks to God every day for the freedoms we enjoy here in the United States of America.
Freedom to worship Him. Freedom to pray to Him. Freedom to read the Bible.
Freedom to speak up and speak out.
Freedom to stand up against wrongdoing.
Freedom to elect our leaders.
Freedom for all Americans.
And I give thanks for the men and women who are on the front lines every single day, defending and fighting for those freedoms.
We can sleep in peace each night because of these brave sons and daughters, husbands and wives, brothers and sisters, grandsons and granddaughters.
Each day, I pray for these soldiers. For those serving at home and those serving all across the world. For those who have returned home wounded - some of the wounds visible and physical, others wounded deep on the inside. For the servicemen and servicewomen who have served multiple tours, each time bravely running into danger.
And I pray for their families. They are heroes too. We lift them up - for their sacrifices, for their burdens, for all that they give as their loved ones serve and fight for our country.
I know that it is only because of soldiers through the years that I can sit here and write this blog. That I can stand up against wrongdoing, speak out and fight for justice.
Freedom isn't free.
It may sound trite - but it's anything but.
There is a price. And it's been paid by these heroes.
My grandfather and uncle served our country. My father-in-law served our country. My wife's cousin is currently serving.
I have friends and colleagues who have served our country in different branches of the military. I am always humbled by their stories and what they have sacrificed, endured and braved. All for us.
That sacrifice comes from love.
Love for God.
Love of country.
Love of family.
Love of freedom.
And love of your fellow man.
"We know love by this, that He laid down His life for us; and we ought to lay down our lives for the brethren." 1 John 3:16
Words can't express how deep our gratitude is to these soldiers.
So, I hope you'll join me today as we remember our veterans - and those currently serving - by taking action to thank them personally.
There are so many groups doing so many different things for our veterans, those currently serving and their families. Because there are so many needs.
We can all honor these men and woman in small but significant ways. It doesn't have to cost much. Your time volunteering is free. Many small donations will add up - and help so many.
We can donate to the USO.
We can donate to the Wounded Warrior Project.
Many soldiers have come home and need a service dog - for physical injuries and post traumatic stress disorder. VetDogs is an incredible group training and providing dogs to veterans.
We can help the Disabled American Veterans.
We can support the Iraq and Afghanistan Veterans of America.
We can donate or volunteer with the Veterans of Foreign Wars.
You may have seen the Cheerios boxes with the postcards to send to families of soldiers serving our country.
We got a box and my kids can't wait to finish it so they can write and send the postcard. I have a feeling we'll be picking up another box of Cheerios so we can send a couple postcards. It's a good thing we all love Cheerios!
It's inexpensive and easy. Grab a box (or two) at the store and send some cheer to the families of soldiers serving all of us.
Clint Bowyer drives the Cheerios car - and he's going to have a special paint scheme this weekend to support soldiers, veterans and their families.
If we all do something, we can let these courageous men and women - and their families - know how much we appreciate all they do for all of us.
And we can keep them in our prayers, asking for God's protection over each of them and over all their families.
I am so grateful to all of our veterans, to those currently serving and to all of their families for all they give so we can live freely. Today, I'll also be keeping in prayer those who have lost loved ones serving our country. For strength and comfort as they remember their family member who so bravely served our country and gave all.
When I see a soldier, I always make a point to thank them so they know how much we support them and are grateful for all they do for us.
My son loves to salute soldiers. He wants to be one when he grows up. They are his heroes. And mine too.
Whatever you do today, I hope you'll find a way - big or small - to say thank you to our veterans, the soldiers currently serving our country and all of their families.
I am so, so proud to be an American. And so incredibly proud of all these servicemen and servicewomen.

You may have seen the Cheerios boxes with the postcards to send to families of soldiers serving our country.
We got a box and my kids can't wait to finish it so they can write and send the postcard. I have a feeling we'll be picking up another box of Cheerios so we can send a couple postcards. It's a good thing we all love Cheerios!
It's inexpensive and easy. Grab a box (or two) at the store and send some cheer to the families of soldiers serving all of us.
Clint Bowyer drives the Cheerios car - and he's going to have a special paint scheme this weekend to support soldiers, veterans and their families.
If we all do something, we can let these courageous men and women - and their families - know how much we appreciate all they do for all of us.
And we can keep them in our prayers, asking for God's protection over each of them and over all their families.
I am so grateful to all of our veterans, to those currently serving and to all of their families for all they give so we can live freely. Today, I'll also be keeping in prayer those who have lost loved ones serving our country. For strength and comfort as they remember their family member who so bravely served our country and gave all.
When I see a soldier, I always make a point to thank them so they know how much we support them and are grateful for all they do for us.
My son loves to salute soldiers. He wants to be one when he grows up. They are his heroes. And mine too.
Whatever you do today, I hope you'll find a way - big or small - to say thank you to our veterans, the soldiers currently serving our country and all of their families.
I am so, so proud to be an American. And so incredibly proud of all these servicemen and servicewomen.

Philip Jordan John (Is this Beacon Financial Advisors newest addition?), Claire Gingrich, Kayla Katherine Kennedy Gingrich Burds Wanken, Dwight Wanken (a Raymond James Financial Services, Inc. Branch Manager of Beacon Financial Advisors), Maggie Gallas (Beacon's Former Legal Advisor) and Jeremy Gallas in a Group Photo? Wow. Just wow.

You know, when I first saw that photo of Philip Jordan John and Claire Gingrich almost immediately after the FINRA arbitration had concluded, I thought "awwwwwww!"
Wait. No I didn't.
I thought it was incredibly strange.
Because Philip Jordan John was working at Beacon Financial Advisors for Raymond James Financial Services, Inc.
And Claire Gingrich is Kayla Katherine Kennedy Gingrich Burds Wanken's daughter.
No not that one.
Her other daughter.
Not Margaret Maggie Gingrich Gallas.
She was the one that was the legal advisor for Beacon Financial Advisors in 2009.
Who was never made available for testimony at FINRA arbitration.
And who Kayla Katherine Kennedy Gingrich Burds Wanken couldn't remember whether or not she had ever discussed Maggie Gallas being called as a witness at the FINRA arbitration. Or whether or not she had discussed the child custody lawsuit that John Dwight Wanken filed against my wife and me - and which Kayla Katherine Kennedy Gingrich Burds Wanken seemed to take an active leadership role in - with Maggie Gingrich Gallas.

And Philip Jordan John was only licensed at the end of March 2010.
You know, this is starting to sound like a "Which Came First?" kinda question.
Now, I know the chicken came first.
Just like I know Adam and Eve didn't have navels.
So that's not the question here.
The question here is -- wait for it...
Assuming the fellow in these photos is Philip Jordan John (which based on my expert forensic photographic analysis, it sure looks like it is), just when did he and Claire Gingrich start dating? And what's going on with this "family" photo?
Were they dating for some time - and the plan was to bring Philip Jordan John in to the business after my license was falsely terminated?
Did they meet sometime after I was wrongfully terminated and he needed a job - and was promptly hired by Beacon Financial Advisors?
Or did he - I don't know - happen upon an ad listed somewhere (maybe on a telephone pole?) for an individual with apparently no financial services experience that had been unemployed for a lengthy period of time to work at a small branch office of Raymond James Financial Services, Inc. during the worst economy (particularly for financial services professionals) in more than 80 years?
Don't worry, folks. We're going to get testimony on this.
Or did they just happen to fall madly in love as soon as he began working at Beacon Financial Advisors?
So madly in love that within months, he was included in a fabulous family photo?

He apparently was interning at a metal fabricating shop. Don't know if that was a paid gig, but it's apparently a very small shop. Of maybe one or two people.
And that was where he was right before he started working at Beacon Financial Advisors.
Which was... Wow... Now look here -- just one month after the FINRA arbitration had finished.
If you were in the habit of wearing tinfoil hats, you might just think that this was a plan for some time. Now I don't wear tinfoil hats. I look for evidence. And proof. And answers.
So was the plan for Philip Jordan John to join Beacon Financial Advisors all along?
Maybe their little plan was delayed after Maggie Gingrich Gallas posted her LinkedIn profile stating that she was the legal advisor for Beacon Financial Advisors.
And then she was called as a witness to testify.
And then - magically - *poof!* Maggie Gingrich Gallas was no longer the legal advisor for Beacon Financial Advisors.
No. Now Maggie Gingrich Gallas was mysteriously assisting an attorney. In Dallas.
What's that? Was Maggie Gingrich Gallas assisting (gasp!) N. Henry Simpson in this arbitration claim?
You know, as I recall, I asked for records during discovery of all people who were working at Beacon Financial Advisors in any capacity. Was Philip Jordan John working and/or interning at Beacon Financial Advisors during this time?
This plot just thickens like a bad gravy.
Well. Let's take a look at the timeline then, shall we?
September 2007 - My mom dies.
October 2007 - John Dwight Wanken states he has met a "new girlfriend" in an online dating service and that he intends to marry her immediately and that she intends to join our business asap. Though she is a preschool teacher and apparently has no financial services experience. (anyone else noticing a trend here?) He demands that my two young children meet her immediately.
November 2007 - John Dwight Wanken refuses to spend Thanksgiving with my family and instead spends Thanksgiving with Kayla Katherine Kennedy Gingrich Burds Wanken.
December 2007 - John Dwight Wanken and Kayla Katherine Kennedy Gingrich Burds (Wanken) throw some variation of - as he described it to me - a "New Beginnings" themed Christmas party at Kayla Katherine Kennedy Gingrich Burds Wanken's house. Apparently, our clients are invited to the party. John Dwight Wanken demands that I attend with my family. I decline and tell him neither I nor my family are ready to meet his "new girlfriend" just weeks after my mom's death. I can't help but wonder what that New Beginnings theme thing is. New beginnings. Huh. I wonder why they're having this party at her house. He would later tell me that he had moved into her house. In case you missed it, my mom passed away just weeks ago. I am still mourning her death and am not ready to meet Kayla Katherine Kennedy Gingrich Burds Wanken. Were my family and I the only ones grieving mom's death? What kind of "New Beginning" was necessary? Was there something before the "New Beginning?" I dunno. I'm just confused by all this.
December 2007 - John Dwight Wanken tells me he wants to plan an outing with my daughter. He tells me he has planned everything and that he is going to take her to American Girl. My daughter has never spent any time with just John Dwight Wanken and I tell him no. He insists. I begin to get curious. I ask a few more questions. Out of curiousity. Logistics questions a dad would ask. And he's weirdly evasive. The lightbulb pops on over my head. I ask if Kayla Katherine Kennedy Gingrich Burds (Wanken) is going to be there. Silence. He admits that yes, he was going to furtively introduce my young daughter - 5 years old who had just lost her nana - to his "new girlfriend" despite my clear statements that none of us were ready to meet his "new girlfriend." Talk about deceptive and evil, huh? I had already - several times - said no, we weren't ready to meet Kayla Katherine Kennedy Gingrich Burds Wanken yet - just weeks after my mom's death. His response was to plot a secret meeting under false pretenses, misleading me to believe he was planning a special day with my daughter. The whole time, the real reason was to introduce my little girl to his "new girlfriend."
Nice. Way to stay classy. And honest. Ick.
Would you trust this guy to take out your trash? I wouldn't. Ahem.
December 2007 - John Dwight Wanken threatens to terminate my financial services license if I don't immediately meet Kayla Katherine Kennedy Gingrich Burds (Wanken), introduce my two young children to her, attend personal counseling with him at her personal counselor and visit socially with the two of them. He declines our Christmas invitations but tells us that he can squeeze us in between his numerous activities with Kayla Katherine Kennedy Gingrich Burds Wanken's family. He then goes on a long vacation to California with Kayla Katherine Kennedy Gingrich Burds (Wanken), Claire Gingrich, Maggie Gingrich (Gallas) and Jeremy Gallas.
January-March 2008 - John Dwight Wanken continues to threaten me. He locks me out of the office. He removes my access to our client records. He threatens my "precious assets" in emails. He tells me he will enter into a legal attrition fight with me if I challenge him. And then he terminates me and falsifies and defames my FINRA U5.
February 2008 - Philip Jordan John lists that he is unemployed between 2-2008 and 10-2008.
OK. That song isn't cheesy.
April 2008 - John Dwight Wanken and Kayla Katherine Kennedy Gingrich Burds Wanken are married.
April 2008 - August 2008 This case is before the 416th District Court in Collin County. John Dwight Wanken files a motion to compel arbitration several months into the case. The motion is granted - but John Dwight Wanken and Henry Simpson are sanctioned for delaying litigation while they had the intent to file the motion to compel the entire time. A week before the hearing, John Dwight Wanken, in what apparently was a stalking, followed me to my hair appointment, physically assaulted me and demanded that I drop the lawsuit. He also admitted we were partners and demanded to know why I had told our clients and partners the truth.
May 2008 - John Dwight Wanken apparently uses me to renew his health insurance policy - even though I was no longer supposed to be covered as of May 1, 2008. John Dwight Wanken would tell the Texas Department of Insurance that he had employees in May - but Claudia King and Kayla Katherine Kennedy Gingrich Burds Wanken were employed elsewhere until later in the summer, according to FINRA Broker Check and their own FINRA testimony.
August 2008 - Claudia King, Kayla Katherine Kennedy Gingrich Burds Wanken's best friend, is licensed by FINRA and begins working at Raymond James Financial Services, Inc. according to her Broker Check. She also apparently has absolutely no financial services experience.
August 2008 - Kayla Katherine Kennedy Gingrich Burds Wanken begins working at Beacon Financial Advisors. Her various titles were some variations of "Director of Special Projects", "Director of Strategic Marketing" and other nebulous titles. At arbitration, I never did understand what she was testifying about regarding what she did at Beacon Financial Advisors. I do however remember her yelling "Oh! Object all you want!" That was funny. What wasn't funny was how the FINRA arbitrators handled her outburst. Because the chair of the panel said that the FINRA arbitration hearing was just an informal gathering. Really? Wow.
September 2008 - John Dwight Wanken apparently impersonates me and/or misrepresents his identity multiple times to get my daughter's education records from Wilmeth Elementary in the McKinney Independent School District.
Multiple false reports are made to CPS against us.
October 2008 - John Dwight Wanken purchases my wife's and my legal names as domain names. He has now done this four years in a row. Go ahead - go to www.chriswanken.com or www.heidiwanken.com.
October 2008 - January 2010 - Philip Jordan John apparently "interns" at a small metal fabricating shop in Dallas, Larry Whitely Metal Works. For - um - 16 months. That's some internship.
October 2008 - March 2009 - John Dwight Wanken continues stalking, harassing, threatening and contacting me, sending packages to my house, sending emails to me, etc.
March 2009 - John Dwight Wanken files a custodial lawsuit trying to get custody and conservatorship of my two children. The suit is denied and he is sanctioned severely for bringing a groundless lawsuit.
The whole clip is funny. But go to 12:00 to 14:30 for what the evil villain tried to do to the Incredibles' baby...
March 2009 - Maggie Gingrich Gallas friends my wife and me on Facebook immediately after a custody hearing.
July 2009 - Kayla Katherine Kennedy Gingrich Burds sends a blistering letter to my family law attorney attacking him for representing us in the custodial lawsuit. We all enjoy a good, hearty laugh at her ramblings and what perhaps may be defined as crazy talk.
October 2009 - I find out that Maggie Gingrich Gallas is now the legal advisor for Beacon Financial Advisors.
November 2009 - John Dwight Wanken refuses to make Maggie Gingrich Gallas available as a witness. *Poof!* Maggie Gingrich Gallas is now no longer the legal advisor for Beacon Financial Advisors and is now "assisting" an anonymous attorney. Which it now turns out, she may have been "assisting" Henry Simpson on this arbitration case. Huh.
That gravy is just getting downright nasty now.
December 2009 - The FINRA arbiration is held. I have since alleged that John Dwight Wanken and Raymond James Financial Services, Inc. committed fraud and submitted perjured testimony at the arbitration after what I have alleged is a plan to suborn perjury, spoliate evidence and obtain the award fraudulently. I have also alleged (given the Defendants' perfectly matching FINRA testimony that has now been completely contradicted by John Dwight Wanken's TWC and IRS testimony) that this was an intentional plan that involved the lawyers, which, if true, would make it fraud upon the court.
February 2010 - a picture of Claire Gingrich and Philip Jordan John is posted on the Dallas Morning News website at a local bar, The Amsterdam.
February 2010 - Philip Jordan John begins working at Beacon Financial Advisors. Wow. How coincidental. I mean - the arbitration just ended. There's a photo of Claire Gingrich and Philip Jordan John looking pretty lovey-dovey at a club - and then it turns out that he's working at Beacon Financial Advisors. Wow.
His history includes work at a candy store, a Subway restaurant, at a sub-prime mortgage servicer (with apparently no experience in financial services based on his FINRA Broker Check, I cannot help but wonder what he did at the servicer) and then interning at a metal fabricating shop. I mean - seriously. I can see why he would be a tremendous asset to the firm.
Oh. Wait. He didn't have his financial services license at the time he joined Beacon. So - John Dwight Wanken brought on a guy with NO financial services experience and with no FINRA licenses? And then he paid him while he was studying to take the licensing exams? That would be unusual even at a big firm with a budget for sponsoring people studying for the licensing exams. For a small two "man" shop to pay Philip Jordan John while he studies for the licensing exams during the middle of a recession is essentially outlandishly unheard of. Unless you have some sort of personal connection. Ahem.
March 2010 - John Dwight Wanken continues to harass and stalk my family and sends packages for my child to my mother-in-law's home.
March 2010 - I file a Motion to Vacate the arbitration award in district court. I file complaints with the Department of Labor, the Texas Workforce Commission and the IRS asking that they investigate John Dwight Wanken's FINRA testimony that I was his employee, that he paid all of the bills, that he paid all of the leasing expenses, that he was my boss, that he supervised me, that he assigned me daily tasks, that he required me to work at the branch office, that he ordered that my wife and I move from Austin to Dallas, that I was his administrative assistant, that he had all investment authorities and made all investment recommendations, that I was a *horrible* employee and had been for many years, that he had to terminate me because I was unproductive and insubordinate and that he terminated me for not working at the branch office.
March 2010 - John Dwight Wanken posts a violent physical threat against my family and me on his Facebook page.
March 2010 - April 2011 - the TWC and IRS investigate John Dwight Wanken. John Dwight Wanken contradicts *every* material statement he and Raymond James Financial Services, Inc. made at FINRA arbitration during these investigations.
July 2010 - Philip Jordan John, John Dwight Wanken and Claudia King all move over to Carter Financial Management. Yep. All of them. Together. Like a little pod.
At some point, what looks like (and is identified as "Jordan") Philip Jordan John, Claire Gingrich, Kayla Katherine Kennedy Gingrich Burds Wanken, John Dwight Wanken, Maggie Gallas and Jeremy Gallas all take a really cozy "family-type" photo.
It pretty much looks like they all know each other. Really well.
So, it makes me wonder.

One more thing. Remember when John Dwight Wanken said his house was closing earlier than he expected? Turns out his house might have never closed at all. Remember how I told you that the names on the deed include a woman who may be a cousin of Kayla Katherine Kennedy Gingrich Burds Wanken? Well, it looks like the house may never have been sold to her. Because according to public records, there has never been a sale of the house since my parents bought it more than a decade ago.
Another huh, right?
Oh - I know. You want to know answers to all these questions too.

What's that? Was Maggie Gingrich Gallas assisting (gasp!) N. Henry Simpson in this arbitration claim?
You know, as I recall, I asked for records during discovery of all people who were working at Beacon Financial Advisors in any capacity. Was Philip Jordan John working and/or interning at Beacon Financial Advisors during this time?
This plot just thickens like a bad gravy.
Well. Let's take a look at the timeline then, shall we?
September 2007 - My mom dies.
October 2007 - John Dwight Wanken states he has met a "new girlfriend" in an online dating service and that he intends to marry her immediately and that she intends to join our business asap. Though she is a preschool teacher and apparently has no financial services experience. (anyone else noticing a trend here?) He demands that my two young children meet her immediately.
November 2007 - John Dwight Wanken refuses to spend Thanksgiving with my family and instead spends Thanksgiving with Kayla Katherine Kennedy Gingrich Burds Wanken.
December 2007 - John Dwight Wanken and Kayla Katherine Kennedy Gingrich Burds (Wanken) throw some variation of - as he described it to me - a "New Beginnings" themed Christmas party at Kayla Katherine Kennedy Gingrich Burds Wanken's house. Apparently, our clients are invited to the party. John Dwight Wanken demands that I attend with my family. I decline and tell him neither I nor my family are ready to meet his "new girlfriend" just weeks after my mom's death. I can't help but wonder what that New Beginnings theme thing is. New beginnings. Huh. I wonder why they're having this party at her house. He would later tell me that he had moved into her house. In case you missed it, my mom passed away just weeks ago. I am still mourning her death and am not ready to meet Kayla Katherine Kennedy Gingrich Burds Wanken. Were my family and I the only ones grieving mom's death? What kind of "New Beginning" was necessary? Was there something before the "New Beginning?" I dunno. I'm just confused by all this.
December 2007 - John Dwight Wanken tells me he wants to plan an outing with my daughter. He tells me he has planned everything and that he is going to take her to American Girl. My daughter has never spent any time with just John Dwight Wanken and I tell him no. He insists. I begin to get curious. I ask a few more questions. Out of curiousity. Logistics questions a dad would ask. And he's weirdly evasive. The lightbulb pops on over my head. I ask if Kayla Katherine Kennedy Gingrich Burds (Wanken) is going to be there. Silence. He admits that yes, he was going to furtively introduce my young daughter - 5 years old who had just lost her nana - to his "new girlfriend" despite my clear statements that none of us were ready to meet his "new girlfriend." Talk about deceptive and evil, huh? I had already - several times - said no, we weren't ready to meet Kayla Katherine Kennedy Gingrich Burds Wanken yet - just weeks after my mom's death. His response was to plot a secret meeting under false pretenses, misleading me to believe he was planning a special day with my daughter. The whole time, the real reason was to introduce my little girl to his "new girlfriend."
Nice. Way to stay classy. And honest. Ick.
Would you trust this guy to take out your trash? I wouldn't. Ahem.
December 2007 - John Dwight Wanken threatens to terminate my financial services license if I don't immediately meet Kayla Katherine Kennedy Gingrich Burds (Wanken), introduce my two young children to her, attend personal counseling with him at her personal counselor and visit socially with the two of them. He declines our Christmas invitations but tells us that he can squeeze us in between his numerous activities with Kayla Katherine Kennedy Gingrich Burds Wanken's family. He then goes on a long vacation to California with Kayla Katherine Kennedy Gingrich Burds (Wanken), Claire Gingrich, Maggie Gingrich (Gallas) and Jeremy Gallas.
January-March 2008 - John Dwight Wanken continues to threaten me. He locks me out of the office. He removes my access to our client records. He threatens my "precious assets" in emails. He tells me he will enter into a legal attrition fight with me if I challenge him. And then he terminates me and falsifies and defames my FINRA U5.
February 2008 - Philip Jordan John lists that he is unemployed between 2-2008 and 10-2008.
OK. That song isn't cheesy.
April 2008 - John Dwight Wanken and Kayla Katherine Kennedy Gingrich Burds Wanken are married.
April 2008 - August 2008 This case is before the 416th District Court in Collin County. John Dwight Wanken files a motion to compel arbitration several months into the case. The motion is granted - but John Dwight Wanken and Henry Simpson are sanctioned for delaying litigation while they had the intent to file the motion to compel the entire time. A week before the hearing, John Dwight Wanken, in what apparently was a stalking, followed me to my hair appointment, physically assaulted me and demanded that I drop the lawsuit. He also admitted we were partners and demanded to know why I had told our clients and partners the truth.
May 2008 - John Dwight Wanken apparently uses me to renew his health insurance policy - even though I was no longer supposed to be covered as of May 1, 2008. John Dwight Wanken would tell the Texas Department of Insurance that he had employees in May - but Claudia King and Kayla Katherine Kennedy Gingrich Burds Wanken were employed elsewhere until later in the summer, according to FINRA Broker Check and their own FINRA testimony.
August 2008 - Claudia King, Kayla Katherine Kennedy Gingrich Burds Wanken's best friend, is licensed by FINRA and begins working at Raymond James Financial Services, Inc. according to her Broker Check. She also apparently has absolutely no financial services experience.
August 2008 - Kayla Katherine Kennedy Gingrich Burds Wanken begins working at Beacon Financial Advisors. Her various titles were some variations of "Director of Special Projects", "Director of Strategic Marketing" and other nebulous titles. At arbitration, I never did understand what she was testifying about regarding what she did at Beacon Financial Advisors. I do however remember her yelling "Oh! Object all you want!" That was funny. What wasn't funny was how the FINRA arbitrators handled her outburst. Because the chair of the panel said that the FINRA arbitration hearing was just an informal gathering. Really? Wow.
September 2008 - John Dwight Wanken apparently impersonates me and/or misrepresents his identity multiple times to get my daughter's education records from Wilmeth Elementary in the McKinney Independent School District.
Multiple false reports are made to CPS against us.
October 2008 - John Dwight Wanken purchases my wife's and my legal names as domain names. He has now done this four years in a row. Go ahead - go to www.chriswanken.com or www.heidiwanken.com.
October 2008 - January 2010 - Philip Jordan John apparently "interns" at a small metal fabricating shop in Dallas, Larry Whitely Metal Works. For - um - 16 months. That's some internship.
October 2008 - March 2009 - John Dwight Wanken continues stalking, harassing, threatening and contacting me, sending packages to my house, sending emails to me, etc.
March 2009 - John Dwight Wanken files a custodial lawsuit trying to get custody and conservatorship of my two children. The suit is denied and he is sanctioned severely for bringing a groundless lawsuit.
The whole clip is funny. But go to 12:00 to 14:30 for what the evil villain tried to do to the Incredibles' baby...
March 2009 - Maggie Gingrich Gallas friends my wife and me on Facebook immediately after a custody hearing.
July 2009 - Kayla Katherine Kennedy Gingrich Burds sends a blistering letter to my family law attorney attacking him for representing us in the custodial lawsuit. We all enjoy a good, hearty laugh at her ramblings and what perhaps may be defined as crazy talk.
October 2009 - I find out that Maggie Gingrich Gallas is now the legal advisor for Beacon Financial Advisors.
November 2009 - John Dwight Wanken refuses to make Maggie Gingrich Gallas available as a witness. *Poof!* Maggie Gingrich Gallas is now no longer the legal advisor for Beacon Financial Advisors and is now "assisting" an anonymous attorney. Which it now turns out, she may have been "assisting" Henry Simpson on this arbitration case. Huh.
That gravy is just getting downright nasty now.
December 2009 - The FINRA arbiration is held. I have since alleged that John Dwight Wanken and Raymond James Financial Services, Inc. committed fraud and submitted perjured testimony at the arbitration after what I have alleged is a plan to suborn perjury, spoliate evidence and obtain the award fraudulently. I have also alleged (given the Defendants' perfectly matching FINRA testimony that has now been completely contradicted by John Dwight Wanken's TWC and IRS testimony) that this was an intentional plan that involved the lawyers, which, if true, would make it fraud upon the court.
February 2010 - a picture of Claire Gingrich and Philip Jordan John is posted on the Dallas Morning News website at a local bar, The Amsterdam.
February 2010 - Philip Jordan John begins working at Beacon Financial Advisors. Wow. How coincidental. I mean - the arbitration just ended. There's a photo of Claire Gingrich and Philip Jordan John looking pretty lovey-dovey at a club - and then it turns out that he's working at Beacon Financial Advisors. Wow.
His history includes work at a candy store, a Subway restaurant, at a sub-prime mortgage servicer (with apparently no experience in financial services based on his FINRA Broker Check, I cannot help but wonder what he did at the servicer) and then interning at a metal fabricating shop. I mean - seriously. I can see why he would be a tremendous asset to the firm.
Oh. Wait. He didn't have his financial services license at the time he joined Beacon. So - John Dwight Wanken brought on a guy with NO financial services experience and with no FINRA licenses? And then he paid him while he was studying to take the licensing exams? That would be unusual even at a big firm with a budget for sponsoring people studying for the licensing exams. For a small two "man" shop to pay Philip Jordan John while he studies for the licensing exams during the middle of a recession is essentially outlandishly unheard of. Unless you have some sort of personal connection. Ahem.
March 2010 - John Dwight Wanken continues to harass and stalk my family and sends packages for my child to my mother-in-law's home.
March 2010 - I file a Motion to Vacate the arbitration award in district court. I file complaints with the Department of Labor, the Texas Workforce Commission and the IRS asking that they investigate John Dwight Wanken's FINRA testimony that I was his employee, that he paid all of the bills, that he paid all of the leasing expenses, that he was my boss, that he supervised me, that he assigned me daily tasks, that he required me to work at the branch office, that he ordered that my wife and I move from Austin to Dallas, that I was his administrative assistant, that he had all investment authorities and made all investment recommendations, that I was a *horrible* employee and had been for many years, that he had to terminate me because I was unproductive and insubordinate and that he terminated me for not working at the branch office.
March 2010 - John Dwight Wanken posts a violent physical threat against my family and me on his Facebook page.
March 2010 - April 2011 - the TWC and IRS investigate John Dwight Wanken. John Dwight Wanken contradicts *every* material statement he and Raymond James Financial Services, Inc. made at FINRA arbitration during these investigations.
July 2010 - Philip Jordan John, John Dwight Wanken and Claudia King all move over to Carter Financial Management. Yep. All of them. Together. Like a little pod.
At some point, what looks like (and is identified as "Jordan") Philip Jordan John, Claire Gingrich, Kayla Katherine Kennedy Gingrich Burds Wanken, John Dwight Wanken, Maggie Gallas and Jeremy Gallas all take a really cozy "family-type" photo.
It pretty much looks like they all know each other. Really well.
So, it makes me wonder.
Did Claire Gingrich know Philip Jordan John a long time?
Did they wait on bringing Philip Jordan John on to Beacon Financial Advisors until after the FINRA arbitration?
Just how long has Claire Ginrgich known Philip Jordan John?
How *did* Philip Jordan John get the job -- seemingly without any financial services experience during the Great Recession?
Oh - and here's another question.
Why did that little pod move from Carter Financial Management back over to Beacon Financial Advisors?
One more thing. Remember when John Dwight Wanken said his house was closing earlier than he expected? Turns out his house might have never closed at all. Remember how I told you that the names on the deed include a woman who may be a cousin of Kayla Katherine Kennedy Gingrich Burds Wanken? Well, it looks like the house may never have been sold to her. Because according to public records, there has never been a sale of the house since my parents bought it more than a decade ago.
Another huh, right?
Oh - I know. You want to know answers to all these questions too.
Don't you worry. I'm going to get to the bottom of it.
And you know what? It looks like this thing is just going to blow all of our minds over and over again before it's all through. Seriously.
You thought I was exaggerating when I said this thing is a blockbuster?
Nope. You couldn't make this stuff up.
